COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under 13, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation's consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

We do not specifically market to children under 13.


Exceptions

Due to the nature of our business, we are sometimes subjected to threats and intimidation from criminals and even organized-crime operations. It is sometimes hard to distinguish between the threats and intimidation and thuggish behavior of true criminals... from the behavior of simple fools who are not criminals and merely have bad manners when their IP or domain has been involved in sending UBE (spam) and therefore got listed. Either way, any communication sent to us which we perceive as using threats or intimidation tactics to try to influence our editorial decisions, breaks much of the terms of this privacy policy. We reserve the right to use any and all such communications in any way we please that is deemed necessary for our protection and safety, including possibly making the communication public and/or sharing that information with other anti-spam organizations and/or law enforcement agencies. No, we would never sell contact information to 3rd parties, etc. Those parts of the privacy policy remain intact. But any implied or perceived confidentiality in such threatening communication is considered null and void under these circumstances.

47 USC § 230 requires that we get opinions and share intel with our subscribers and partners, regarding our data and matters related to our data. Therefore, should a conflict arise between 47 USC § 230 and a court order, we reserve the right to possibly err on the side of following the plain language of 47 USC § 230, depending on the circumstances. [This is a common legal tactic used by spammers... who know that their best chance for winning such a lawsuit is to convince a gullible judge to include a gag order, in order to keep such a lawsuit as much out of scrutiny and critical examination as possible. They rely on obfuscation tactics since a full examination of all of their activities works against them.]

Also, (partially due to this same 47 USC § 230 requirement) delist requests, in particular, should NOT be considered confidential and are possibly subject to being shared with third parties on occasion, or even made public, when deemed appropriate or necessary.

All of the exceptions stated above apply to all types of communications, including e-mail and telephone. Also, ALL phone conversations are recorded, except where prohibited by law. (That is generally not an issue since we operate out of a one-party-consent state.)
